Motorola is suing BlackBerry-maker Research In Motion for allegedly pilfering its employee ranks, the second time in three months it has turned to the courts to stifle competitive threats posed by departing workers.

The troubled handset-maker, which has failed to match the success of earlier models such as the Razr flip phone, appears to be having a tough time hanging on to key people as the battle for the booming smartphone market heats up between RIM, Apple Inc., Nokia Oyj and others.

Motorola claims in a lawsuit filed in the United States that Waterloo-based RIM has targeted at least 40 Motorola employees, who can’t work for a competitor without revealing trade secrets, despite an agreement between the two rivals that was signed earlier this year.
